Daniel - We've interviewed you a few times regarding poker and your views on it. I was wondering, if we could get one of the supportsrs of the lawsuit, would you be willing to come on and have a debate with them regarding the suit? Thanks

because his judgement is clouded by greed!
It is unclear how the players can reap any financial rewards from this lawsuit. If it is true that they can, then WPTE knew their motives and this is why WPTE refused to negotiate the releases. This lawsuit seemed so trivial that it didn't make sense reading the original complaint, since the players benefit from being on tv at WPTE events. What seems to be the complaint against the players is that the WPTE, in defending itself, will take out online poker and join with the anti-poker lobby to defeat Full Tilt and the playes. Is this the reason the players DN mention are opposed to the lawsuit?

The longer this thing gets drawn out, the worse it is for poker. Just wait till all of the players financial records are revealed in court. Irellevant you say? Not when you are trying to prove damages. The players are claiming financial loss, so the WPT will have every right to open up the books and question in great detail where certain money is coming from. The WPT will go out of it's way to prove that these players are proffiting in a big way from online poker. That's not a good thing, not for them, not for me, and definitely not for the poker world as a whole.
Thanks for being clear and up front about it. I have no doubt that FCP and FTP are very profitable for their owners/consultants etc., and that such information could come to light during discovery. As I sit here in my lofty LA high rise law office, I can envision WPT wanting to make a stink about the 7 players' online poker incomes, tax reporting, you name it. I run into that problem all the time--someone claims lost earnings of X, then we find out when we look at their taxes that they have reported earnings for that period of 1/2 X.I think what you're saying is that there could then be a leap in public and governmental perception related to this--something like, "Holy ----! Howard Lederer made $8.5M off of Full Tilt Poker last year! These guys are getting rich off of kids playing poker and flunking out of college and they're fueling America's gambling habits! Someone has to put a stop to this!" And next thing you know, there's a federal law banning online gaming, right? While these things are a possibility, I personally don't see all that coming from this suit. Sure, it might happen, but this suit isn't as visible as you seem to think, and it's an antitrust case, meaning the focus will for the most part stay on the WPT regardless of how much they try to smear the plaintiffs. You and I can agree to disagree about that, and your opinion's every bit as good as mine.

I have to say Daniel, your main point seemsto be that this lawsuit is drawing negative attention. Although I agree with that point, and so far 90% of what you are saying about it, I must point out that you continually making a big deal out of it is helping it draw that negative attention. I hope you had permission from those other players to list their names. Otherwise you may have opened up a nasty can of worms. If you don't want the lawsuit to draw more attention, you might not want to get so personally involved on a public level.I think it is too late to stop the lawsuit so what exactly are you trying to accomplish?Just a thought.

I think And next thing you know, there's a federal law banning online gaming, right?
Great post, DB10-2.Since the US Justice Dept. is already of the opinion that online poker is illegal, the WPTE can get ahold of financial records belonging to Full Tilt that the Justice Dept. can't get without a warrant. Then the WPTE can give these documents to the Justice Dept., and the JOD can then go after Lederer and Ferguson when online gamining is banned. Could Lederer and Ferguson go to federal prison for running Full Tilt?

I yearn for the good ole days, when the biggest issue anyone had with each other was a certain someone's attitude, poor hygiene, putting their sweaty, pregnant feet all over the chairs at Bellagio, and her umkempt, monster, 70s afro style bush. On this subject, I quit giving a damn about what Andy Bloch says after his display at the world series this year. He had a valid point(as they do in this lawsuit). The way he went about expressing himself is how I see this whole group acting. The only difference is instead of screaming, they're throwing legalese at each other and slamming gavels instead of pounding tables. Yes, when you stand up and scream people hear you. It's just they tend to step slowly away instead of coming to your defense. Eventually you stand alone, defending your own actions(full tilt...) instead of accomplishing anything you set out to do, and coming to a peaceful resolution that's to everyone's satisfaction. The bottom line is this is just business boys and girls. It doesn't matter if it's about the release, or protecting your own online interests. Quit calling each other out like you're on the damn playground. You should ALL be embarrassed of the way you're acting. Quit tarnishing the images you're fighting tooth and nail to protect. It's getting to the point it did with baseball during the strike. No one really cares about how you split up the millions, and who endorses what, and how much they get paid for it. "Excuse me ladies and gentlemen, the Sit the fvck down and Shut the fvck up light is now on. SO SIT DOWN AND SHUT THE FvCK UP!"

BINGO !!! It amazes me that any logical person can't see where this is headed. I hate to think of the damage this will cause.

what "damage" do most of us even have wrapped up in this? what do we care? i can't see how most players here aside from DN and maybe a few other high stakes pros would even care. so what if DN can't make money off FCP's poker room? what do you care? all it probably means is that if you want to chunk off your money in $25-$100 increments, you'll just have to find another way to do it.there are so many people on this board who say the lawsuit is bad when it's clear they're only doing so because DN says so. it's a joke.

So basically you're saying that WPTE wants to ruin online poker for Americans? Because the group of 7's claim was to open up the language of the release & open casino's that host WPT events to other televised events.....not to ruin online poker. I guess all of my fellow American's should thank the WPTE (and you) for trying to "force" us into the B & M cardrooms to support Lyle & his fellow casino owners.Read the lawsuit. It doesn't state any claim regarding online poker. The losses they claim are not from endorsements or investments, they are tourney winnings. IMO what the WPT has done is to try and distort the case to ENCOURAGE negative connotations & media coverage for poker.....Thanks for supporting that instead DN ! (SW)

DN,Please explain to us why WPTE does not just change the wording in their release form. The release is what this is really all about. If the WPTE says they won't ever use someone's likeness to promote anything other than the show, why don't they just put that in writing? All the other stuff in the lawsuit is just in there to get the courts to pay attention.Additionally, if the lawsuit really has no chance (or whatever you have said about it), why does the WPTE have to bring up online poker profits of the 7 in a public release? That's just vindicitive, not to mention VERY bad for poker, overall.BTW, these players boycotted the WPT events for atleast last season, possibly longer for some, yet you rip them for not trying to discuss this first, instead of going straight to a lawsuit. They have tried discussing this for over a year to no avail. And last, I am curious about your deals with Stacked and FCP, and how you are not breaking any agreements when you sign the WPTE release. Or is just that Lyle is your buddy and you know he won't do anything to put you at risk?

Daniel, thank you for your candor. I respectfully request that you write about this in your blog in more detail. I'd like to ask: why is this lawsuit so bad for poker--so far, DN hasn't made it perfectly clear.
You absolutely have to be kidding if you've actually watched the video blogs, read the written blogs, read his posts, etc. I simply don't understand how someone as well spoken as you can completely miss the answers to your questions.

So the seven of them are going to stand there in open court and try to prove damages. Financial damages. That means revealing all of your finances from all sources and then trying to prove that it should have been more but because of the WPT it wasn't.How many people who make their living from gambling and endorsements are willing to disclose their full financial portfolio in open court? Do you think that it is going to match with what they claim with the IRS? Do you think all the money from all the cash games gets declared? How about all of the money from pro's getting invited into tournaments that now 100 people online sign up for because they want a shot to play agianst Annie Duke? So now these 7 disclose and the court finds not only did they not suffer damages, but in fact made a whole sh*tpot full of money that maybe they did declare and maybe they didn't. What do you think the goverment is going to do next? Assume that it ends with these 7 players? Nooooooo.... they are going to look at all the pros.Hundreds of professional gamblers are going to be at risk of having to disclose their full financial portfolio's and all of thier sources of income. That is how it is bad for poker. Poker made these people millions and they are willing to allow the government to stick a microscope up their asses for a few bucks more.
