If that hadn't happened yet, then I think it would be up to the casino/poker room. Robert's Rules leave some room for interpretation:Dead Hands2. Cards thrown into the muck may be ruled dead. However, a hand that is clearly identifiable may be retrieved at management’s discretion if doing so is in the best interest of the game. We will make an extra effort to rule a hand retrievable if it was folded as a result of false information given to the player.The Showdown2. Cards speak (cards read for themselves). The dealer assists in reading hands, but players are responsible for holding onto their cards until the winner is declared. Although verbal declarations as to the contents of a hand are not binding, deliberately miscalling a hand with the intent of causing another player to discard a winning hand is unethical and may result in forfeiture of the pot. (For more information on miscalling a hand see “Section 11 - Lowball,” Rule 15 and Rule 16.)A similar question was posed on RGP awhile back, and a floorperson posted saying in a cash game he would declare the hand hand dead, but in a tournament he would declare the hand live.That being said, I don't think you will ever get the house to pay out the bad beat jackpot if they don't have to. At least that's how it is at every casino I've played at that has jackpots. They like paying them out, it's fun, it doesn't cost them anything and it adds to the excitement.Until I see the video from the eye in the sky for this incident though, I'm still saying b.s.
