Hey guys, Me and 2 friends are looking at purchasing property in downtown Tyler and starting up a private poker club. We would do it up right with TVs and couches and super nice tables and chairs and everything else. We are thinking about charging $100 a month but we would not take a rake or anything like that and we would still offer free drinks and other things. Do y'all think that this idea would get any traction around the area? and would any of y'all be interested in joining if this gets off the ground?

It'll fail.You're charging a tiny fraction of what most card rooms do, but the only people who will care are the ones who you dont want.ie: The ones who will end up drinking and eating more than they're paying a month in membership fees.A nightly fee would work better, but a normal rake still allows you to make far more and you run roughly the same risk of being shut down by cops. They arent going to haggle over how you charge your rake, they just care that you're profiting.

exactly what abba said, wait until its legal, which is closer in texas than most people think. Harrahs quietly bought up several casino ripe properties in galveston recently: old hotels that were already wired to work as casinos. Expect it to be tied to the lottery (ie. money for texas education) when the bill gets introduced.

I think that this would not go over well in Smith County. They are notorious for tough prosecution of just about anything. If I was to do it, I'd take it just outside the County Line. Maybe Henderson County or thereabouts. Downtown Tyler is too close to the Courthouse and businesses. You'd be busted in a month.

Unless, like in Houston, there are off duty cops working security.

When I have talked to friends who are in the TABC (that is who has the jurisdiction), as long as there is nothing else illegal (drugs, prostitution, etc) going on in the house, they don't care. They do have to investigate if somebody complains about noise or traffic, but for the most part, they don't care

Based on previous games shut down in texas, you are considered breaking the law if you are profiting from the game (a house charge / membership fee). Even if you have accounting records to show that you were only breaking even after paying for all the food / drink, you're still breaking the law. I'm in no way condemning you, just an FYI.

FinanceMajor-I know a little more about this than you might think and I am also pretty close to you geographically speaking. There is no question that what you are suggesting is, according to the Texas Penal Code, completely illegal. Don't get me wrong...I'd play the game and take the risk as a player but you have been getting bad advice if you think that you are even close to the legal side of the line. Whether TABC/J.B Smith/TPD enforces it is another story because we all know that the law is only an issue if it is actually enforced. But as far as thinking it is legal, you are incorrect. I would like to say that I know any room with a rake is illegal in Texas. I was just saying that the TABC doesn't want to mess with little poker games when they have other things that are more important

3 words - Austin Poker ClubMy guess is you're new to the game? Anyone who's been around the game in Texas for a while knows that you can not do what you are intending; it will be shut down and you'll be in jail quicker than you can seat a full table.

to the OP i would go to some clubs in houston (vip) or dallas (redmans) and find out some info.i think tyler would not be a good location because your too close to LA. good luck with what ever happens.
