Being Sued By Cc Company, Need Advice, Please Help!

How are you living on $1000/month ? You really need a second job, tear up the cc's, stop going out, drinking, etc. Get a lawyer to help with communicating with the cc company.
Absolutely agree. cut all remaining credit cards into pieces. Credit cards are definitely -EV. Get a second job and take some responsibility for your actions.

I saw on the news this morning about people selling plasma for gas money. That's an extra $40 a week !!! Three years of selling plasma and you are debt free !!

Don't be a welfare case and file for bankrupcy. Contact a debt solution company as another poster stated, get a plan, and work your arse of to get it paid. If you are willing to work, $6,000 is not much money. Work hard! Work evenings and weekends. You got yourself into this mess, get yourself out. You will learn a lot in the process.DON'T TRY TO EARN IT PLAYING POKER!Be responsible and don't turn your problem over to the tax payers.Good luck!

thanks for the help. Unfortunately I don't have enough to even pay them half of what I owe. When I got served, I called the law office to try and settle the debt in payments to avoid court. I said I could afford $100/mo. The guy said he has to ask his "boss", and he never got back to me. I never made the court date a week later, thinking we could work something out. Next thing I know I got a thick envelope in the mail saying they got a judgement against me (automatic I guess since I didn't show) and owed more than $6 G's when you throw in the lawyer's fees and stuff. If I file for Chapt 7 or 13, will it take care of a judement or is it too late? I wanted to avoid bankruptcy to keep my family from finding out but I guess I may have to consider it since I also do owe other credit cards that I'm behind on. What I'm wondering now is can I be granted a bankruptcy when most of this debt was from gambling? I mean the money was taken out pretty much like a cash advance, in most cased directly to the poker sites. It's not like I just overspent or bought stuff that I needed to survive with, but I gambled it away like a moron. Won't the judge be hard on me? I did file for chapter 7 and it was granted in 1999 but believe it or not that wasn't from gambling. But the fact that I did it before makes me believe I can't just do it again. I can afford to pay back creditors around $300/mo total so I may try chapter 13 if possible. Has anybody else here gotten into this kind of trouble? It's a pretty hopeless feeling but completely my fault. I've stopped playing poker, even stopped watching poker, and don't plan on playing again.

I like this one, countersue them because they are causing you mental illness for sueing you lousy 6k, or sue their TV ads are sick and poisoning the young minds of the degenerated gamblers, etc.

OP,Counter-Sue Capital One for allowing you to partake in an illegal activity... Claim they should have blocked these illegal transactionsOnce they have written off the debt, sue them for mental stress and then from $6k in the hole you are debt free and $50,000 richer. Another product of the fine American systemYou can then become the billboard face for the anti-gambling commission (unless you are fat and ugly, which I presume you are)you are welcome

Here's an idea....Get a $100K loan, and go sit at the "big game" w/ 4K and 8K blinds...push in the first hand, steal the blinds, and leave....Then you'll have the debt paid plus 6K!! (j/k please don't do this)

lolThis is the best solution. If you lose the hand you can declare bankruptcy anyway, and if you win the hand the problem is solved.

I can get you a job $1000 a week planting tulips.....two lips on my A$$! hahahahahajust kidding. go to the bank and get a 60 month loan for $7k. Pay off the $6k you owe and use the $1k to build your roll and pay off the loan. You can be out of this in a yr.

If he did actually try this and told the players his situation....would they have the heart to take his money?....I could never prey on somebody that down on their luck, bad karma.Sorry to get off track but dude, work your *** off to pay that debt...trust me you can do it. Good luck!

Don't get a loan!Talk to them, don't avoid the situation it'll only get worse with time. I also agree with the others to get a 2nd job and work at it, you can pay this off.

Thanks for all the advice guys, I really appreciate it! Just to be clear, my total debt is actually around $10,000 when you count the other cards that I owe. The $6,000+ is just what the Capital One has successfuly sued me for and has a judgement against me for. They will start collecting on this soon, and I was worried about the wage garnishment part, or about them trying to seize my car. I do make a little over $1,000/mo, was just using that even figure to make my example easier to explain the wage garnishment part. Like I said, I can pay back about $300/mo, but the law firm that represents Capital One will not talk settlement ( I assume because they already won a judgement against me), they just want to start their collection methods. This sounds ridiculous, since if what you guys stated was true about wage garnishment they won't be getting much every month. Also getting another loan to pay of these debts is impossible for me; my credit now is so bad I even got turned down for a Sears Card the other month. The lady at the register told I could save something like 20% on my purchase right there and then if I apply and got it, and she said everybody can get the card. I told her my credit was terrible and it's not worth the time but she insisted they have easy approval requirements and said as long as you have a job you should get it, since practically everybody who applies for one does get approved. BTW, I do have a second job. The cost of living here is ridiculous, but I have family, my sister and nephew, here and don't want to run away back home. I'm sure If I wanted to it would be easy to move (disappear) back to California and never hear from the law firm again, but I wouldn't want that on my conscience. I know in the back of my mind I would be worried about every phone call I get at home or every big envelope that comes in the mail , that maybe one day they will find me, and with the interest will be something like an additinal $20,000 or something. Anyway, I really do appreciate the help. I will make an appointment get some free advice from a bankruptcy attorney to see what to do also. I'll report back here what happens just in case there are others out there like me. Later

Guess you've never heard about the 100k loan to Stuey from an unnamed person. He was running bad, "someone" loaned him 100k, and then proceeded to mop the floor with Stuey...classic stuff

I don't think there are to many banks that will give him a loan if he has jugements out againt him.

here in the wonderful state of taxachusetts.. there are non-profit agencies that will advocate for you to do settlements..it wont be great for your credit rating but they do negotiate pretty decent settlements....dont know which states have comparable agencies but worth checking out....glglquote name='Devorzon' date='Wednesday, May 24th, 2006, 12:42 AM' post='1094488']thanks for the help. I may come off like a huge ***, but you have two jobs and make just a little over $1,000 a month? Working full-time making minimum wage almost gives you more than that.
