The amount of times "sick" has been used in this thread, "sick brag", "sick sweat" and shit makes this thread intolerable. This isn't a surfing forum and it isn't the 1980's.

This is another of those "kick the can down the road" things that each congress and administration does. Do they think we can keep ignoring our WTO commitments forever? Are we going to ignore it when the WTO says "OK, go ahead and pirate all US movies and songs since the US obviously doesn't care about free trade"? At some point the WTO will get tired of waiting, and something's gotta give. Maybe this prosecution will be the straw that broke the camel's back.

Mr. Elie was arrested in Las Vegas on Friday. He was released to marry former Playboy Playmate and model Destiny Davis in Las Vegas Saturday. He voluntarily surrendered for his arraignment in New York Tuesday. Mr. Elie, as a payment processor, is alleged to have lied to U.S. banks that didn't want to process the money paid to PokerStars, Full Tilt Poker and Absolute Poker by U.S. residents for fear of violating the Internet Gambling Enforcement Act.
Mr. Cowden said he gave the prosecution a 500 gigabyte empty hard drive for them to start the process of "discovery," to show the defense what evidence they have, as Mr. Cowden said he and his client are interested in getting the case "moving."

It said you can't drink beer. Well, people drank beer anyway. And poker's about as American as apple pie.... The situation cries for regulation so that states can get money at a time when they need money and the federal government can get some money at a time when it could use the money. It seems like an intelligent thing to sit down and regulate.

One of my friends woke up this morning to find his bank account frozen due to "unapproved offshore wire transfers"...the only transfers he's received are from Full Tilt. Be aware kiddos, might not be a bad idea to get yourselves a cash reserve just in case.

It doesn't sound like the government's case is all that strong. So, why are they doing this?I just keep remembering the "blackout" provision of the lame-duck bill from late last year, and who was responsible for it. Harrah's. Now, I'm not saying that Harrah's is evil, I think they just want a piece of the action, and I honestly can't blame them. The US is a few years behind the times on all of this, and Harrah's (and others) are paying the price.My guess is that this situation will develop as follows. Many of us have written our Congressmen to complain, so a little bit of action will begin to stir in Congress. One by one, other states will begin creating pacts with Nevada. These will allow their citizens to enjoy online poker with the Nevada casinos, and those states will get a share (of something). In perhaps 2 years, online poker will (for all intents and purposes), be legal in the US (I bet a couple states will still be holdouts). I'm not even sure that the federal government will need to do anything*, after all, gambling is not supposed to be regulated by the US government at all: it's an issue that was left up to the states. In fact, the Constitution actually tells the federal government to essentially "regulate commerce...among the several states", not "hinder" the interstate commerce. But of course, the federal government does all kinds of things that the Constitution never gave it the authority to do, so I guess it is possible that something could happen at that level, but ultimately, I think the next move needs to come from the states. So, bring your state representatives up to speed as well.If we had Nevada casinos operating legally right now, today, the UIGEA would fall into a completely different light, because then it's "lawful Internet gambling", but only if I'm in Nevada? In fact, I think it's going to be difficult to figure out what the UIGEA will mean once the Nevada casinos go online. I mean, if I live in Nevada, and have a bank in Michigan, they can't block the transfer of payments, so they won't be blocking any money transfers for those casinos for anyone. So, at that point, it's left up to the casino to determine who is eligible to play and who is not. Isn't that exactly what Pokerstars and Full-tilt were doing? You won't have to be physically present in Nevada in order to play. (Technologically speaking, I mean. Legally, you will have to be present, but no one will be enforcing that.) But obviously, you would need a Nevada address.*The federal government needs to update the Tax Laws regarding gambling, for reasons I've mentioned here before (let us "net" the income, please, or don't tax it at all). Short of that, let's just hope they don't start attacking us to get tax money from winning players making a few hundred bucks a year. I mean, does anyone pay "Use Tax" on their state taxes? "Yes, I bought $300 worth of stuff from Amazon last year, and I didn't pay my sales tax, so here it is." Get real.

But, unfortunately, there remain significant practical and legal impediments to returning funds to players in the immediate future. As a result of the recent enforcement action, there exists no authorized U.S. payment channel through which to make refunds; Full Tilt Poker has no accounting of the millions of dollars of player funds that were seized by the government; and the government has not agreed to permit any of the seized player funds to be returned to the players. Finally, there are numerous legal and jurisdictional issues that must be considered before poker winnings can be paid out to players throughout the United States. While Full Tilt Poker continues to believe that online poker is not illegal under federal law or in 49 states, the indictment and civil forfeiture action filed last Friday require Full Tilt Poker to proceed with caution in this area. Notwithstanding these issues, Full Tilt Poker is ready to work diligently with the United States Attorney’s Office in the Southern District of New York to try and resolve these issues and to get players their money back as soon as possible.

Sorry but I havent read the whole thread and not sure what the exact situation is.Are US players allowed to transfer to Non US and have them facilitate a cashout?Im not sure i would want to engage in this behaviour as technically I would be engaging in "illegal" activities as well..But my cousin in the US just texted me and asked me if this would work.Cousin transfer money to me, and I ship him money on Paypal.

Just got a POP Up From PokerStars that funds to US players are being returned and one of the girls has just cashed out on Stars

Both poker sites have agreed not to allow real money poker games for U.S. players and to allow for independent monitoring of their compliance.Eleven people, including the founders of PokerStars, Full Tilt and Absolute Poker, were charged Friday with bank fraud, money laundering and online gambling. The U.S. Department of Justice is seeking at least $3 billion in civil money-laundering penalties and forfeiture.

That "question" is awful.I recently was on a uso tour to two countries in the middle east. It was a very rewarding experience, and i was surprised by the insane amount of interest our troops have in poker. I expected most of the troops to have barely played before and maybe seen poker on tv once, while having no idea who most of us were, but I was way off. At... each event we had 100 people who signed up in time, and more who wanted to play but were unhappy that they couldn't get in. All the bases were randomly chosen, and for 3 of the 4 tournaments, less than 1200 people were eligible to signup. So this means far over 8% of servicemembers really enjoy poker from our sample size. Irrelevant stuff.Why then, 2 days after this tour, did the department of justice go after online poker, while at the last base, multiple soldiers are still playing online and trying to bring freedom to the world- yet when they come home they'll be unable to play.Confusing as hell. Is he questioning the timing of it? Did you know about the doj's action on friday?Really?Is there anything you plan to do about it?This is the only thing anybody actually cares about.And if you're actually writing something to be answered by the President of the United States, couldn't you take the time to make it at least look a little more formal?
