Also, you'll have to fork over half the cost of moving the fence back to it's proper boundary. This is kind of important when you go to sell your house. Basically, the person buying will have the platt and they will see the boundaries are wrong and depending on how long the fence has been there, the new boundary may be legally binding. You have to take part of the blame for letting your previous neighbor plant a fence on your property.If nothing else, you need to find out the time frame for disputing his fence line in your jurisdiction.the guy put the fence there when the person we bought the house from was still living there.Your mother shouldn't have to deal with this issue IMO. Now would be a good time to go have the conversation with him about the placement of the garbage can, the property line and most importantly his comment to your mother. He sounds like he's a prick since he spoke that way to your mother. Any man that would make a comment like that to a woman needs to clearly have explained to him that from here forward he comes to you with any issues, not your mother. His reaction should be apologetic for the comment. What you need to do is find out from the former owner when the fence was put there. If it's been there more than 10 years and you didn't inform him of the encroachment during any of that time then I think you're out of luck. Some states it's 7. And here in Montana, all you have to do to prevent adverse possession from taking place is inform him with a notarized statement of the encroachment. I'd also recommend going to your county courthouse and looking up not only your property but also a copy of his plat as well. Reason being is we have a similar situation with our property. When we bought the property we noted on our copy of the the deed that there was a utility easement along one of the sides of the property. That was fine, no problem. Until our neighbor that was kitty corner from us in back came over and informed us that we had our fence on his road easement. Then he showed us his deed and sure enough, it showed a road easement on our property attached to his deed. He was actually being a real prick because he couldn't even legally get to that easement from where his property lay. But he wasn't going to let it go. Basically he sent us a notarized letter informing us of the encroachment of our fence on his easement. He'll never be able to use the dang thing. Anyway after investigating what it would cost us to try to get the easement recinded we decided to just bag it and let him have his easement. Never moved the fence or anything else. The end result? Even though the one guy threatened to knock it down with a sledge hammer, the fence remained in place because it was there for too long and the 1 foot of land reversed ownership.They don't talk to each other anymore.
