Annoying Neighbors

I'm telling you, talk to a lawyer. It's going to be the only way you're going to get your property line reset. Also, you'll have to fork over half the cost of moving the fence back to it's proper boundary. This is kind of important when you go to sell your house. Basically, the person buying will have the platt and they will see the boundaries are wrong and depending on how long the fence has been there, the new boundary may be legally binding. You have to take part of the blame for letting your previous neighbor plant a fence on your property.If nothing else, you need to find out the time frame for disputing his fence line in your jurisdiction.
the guy put the fence there when the person we bought the house from was still living there.
Your mother shouldn't have to deal with this issue IMO. Now would be a good time to go have the conversation with him about the placement of the garbage can, the property line and most importantly his comment to your mother. He sounds like he's a prick since he spoke that way to your mother. Any man that would make a comment like that to a woman needs to clearly have explained to him that from here forward he comes to you with any issues, not your mother. His reaction should be apologetic for the comment. If not, then you 100% know what you're dealing with and you can take appropriate action with the town government for parking issue, the police for the harassment issue and a lawyer for your civil issue.
my mother has video evidence of the trailer and where she placed the trash can. im at my girlfriends right now and my step dad is working overtime so that's why my ass wasn't outside there jawing back at him

Dont look at this as a bad thing....You can have endless hours of fun making this jerks life a living hellFrom sulpher and chicken feather grilling when the wind cooperates in his direction to planting a pot crop in his backyard and informing the authorities, you have a golden opportunity hereI look back at my days of fun with neighbors as some of the most enjoyable memories ever...Back then, catalogs still accepted COD orders and utility companies didnt require identity verification before adding or cutting services. Im proud to say that I probably played a small role in the changesYou would be surprised how just a small convex security mirror from a grocery store can send a blinding laser like beam directly into someones house during a certain time of day. A modified satellite dish pointer works well to adjust the beam comfortably from a recliner. Plus, on overcast days you can use it to count the pizza delivery men and service guys like plumbers and electricians that enter his drivewayI sometimes wish I had a bad neighbor to mess with again....They all moved away for some reason

Yea, that a better idea.While you're watching the fence burn - dump the garbage in his front lawn and p iss on his vehicle when he parks in the wrong spot.

It may be too long to get the fence removed due to adverse possession in which case you're out of luck. What you need to do is find out from the former owner when the fence was put there. If it's been there more than 10 years and you didn't inform him of the encroachment during any of that time then I think you're out of luck. Some states it's 7. And here in Montana, all you have to do to prevent adverse possession from taking place is inform him with a notarized statement of the encroachment. I'd also recommend going to your county courthouse and looking up not only your property but also a copy of his plat as well. Reason being is we have a similar situation with our property. When we bought the property we noted on our copy of the the deed that there was a utility easement along one of the sides of the property. That was fine, no problem. Until our neighbor that was kitty corner from us in back came over and informed us that we had our fence on his road easement. Then he showed us his deed and sure enough, it showed a road easement on our property attached to his deed. He was actually being a real prick because he couldn't even legally get to that easement from where his property lay. But he wasn't going to let it go. Basically he sent us a notarized letter informing us of the encroachment of our fence on his easement. He'll never be able to use the dang thing. Anyway after investigating what it would cost us to try to get the easement recinded we decided to just bag it and let him have his easement. Never moved the fence or anything else. But every 10 years like clockwork we receive another letter from him,lol.

Sorry, but it sounds like you are just as much of a pain in the ass as your neighbour.Well, maybe not, but a passive aggressive approach like the garbage can thing isn't going to solve anything...

seeing that i'm doing everything legal, i'm obv still a pain. that truly makes since.....anyways some new developement. they ticketed the guy for illegally parking next to a trash pick spot and my neighbor across the street told me that there were apparently numerous tickets that that put on the this guys door. finally this pos system is working

Why did you feel the need to mention his nationality?Sounds like a pissing contest on where the trash can goes. Get you a neighbor with a barking dog.... then you'll appreciate this guy.

The neighbours 2 down from my parents where I grew up were best friends with their next door neighbours, until this exact same thing came up about a 1 foot difference in property because of the fence.It got to the point where they both got lawyers and were sending letters back forth through them. The end result? Even though the one guy threatened to knock it down with a sledge hammer, the fence remained in place because it was there for too long and the 1 foot of land reversed ownership.They don't talk to each other anymore.

maybe cuz we have more than one race in miami...other than that i have no other reason lol. i feel like pulling a billy madison and doing the whole dog shit in a paper bag and lighting it on fire, but would wanna video tape this and put it on youtube for all to enjoy
