Yeah, actually they can. The photographer owns the copyright to the photo, so they get to choose whether it gets used. They can even sell prints of it without your permission if they want. The only thing they can't do is grant rights for its use on a product or to endorse a product without you signing off. That said, most photographers would give free permission for use of the photo on the subject's website. It's promotion and good karma. Problems happen when the photographer isn't asked.
